Lac Vieux Desert Cannabis, LLC, d/b/a Wild Glow Cannabis Company (“Wild Glow”) owns and operates this website (hereinafter referred to as the (“Service”). The terms “Wild Glow”, “company”, “we”, “us”, and “our” mean Wild Glow. The terms “you” and “your” mean the individual who visits or uses our Service. By using and/or accessing this Service, you agree to comply with and be legally bound by Wild Glow’s Privacy Policy and these Terms of Service. 

Acceptance of Terms

PLEASE READ THESE TERMS OF SERVICE (“TERMS”) CAREFULLY. THESE TERMS ARE A LEGAL AGREEMENT BETWEEN YOU AND WILD GLOW, AND ALL RELATED AFFILIATES FOR USE OF THE SERVICE, COMMUNICATIONS, UPDATES, INFORMATION, THE SERVERS USED BY THE SERVICE, THE COMPUTER FILES STORED ON SUCH SERVICE, AND ALL RELATED SERVICES, FEATURES, AND CONTENT OFFERED BY US (COLLECTIVELY “AGREEMENT”). BY VIEWING, READING, ACCESSING, OR INTERACTING WITH THE SERVICE AND ANY PAGES THEREOF, OR WITH ANY BANNER, POP-UP, OR ADVERTISING THAT APPEARS ON IT, YOU ARE AGREEING TO ALL THE PROVISIONS OF THIS AGREEMENT AND WILD GLOW’S PRIVACY POLICY.  We may also store data snippets (“cookies”) on the user or end-users’ equipment, as allowed by acceptance of cookies through your local preferences. When you access or use the Service, you represent that you have read, understood, and agree to be bound by the Terms of this Agreement and to the collection and use of your information as set forth in the Privacy Policy. We require that all visitors to our site adhere to the following Terms. If you do not agree with these Terms, you should immediately cease using the Service. If a user violates any of these Terms, we reserve the right to cancel accounts or bar access without notice.

Modification and Changes to the Terms of Use

We reserve the right, in our sole discretion, to update or modify the Terms at any time without notice to you. Any changes to the Terms will be effective upon posting them on the Service. Your continued use of the Service after the effective date of an updated version of this agreement will indicate your acceptance of the Terms of the agreement as modified.

Use of Our Service

You may only use this Service if you are domiciled in the United States and are 21 years of age or older. Unless you have entered into an express written contract with Wild Glow to the contrary, visitors, viewers, subscribers, consumers, or customers have no right to use this information in a commercial or public setting; they have no right to broadcast it, copy it, save it, print it, sell it, or publish any portions of the content of the Service.

We are not engaged in rendering medical or similar healthcare advice or services via the Service. The information provided via the Service should not be interpreted as a substitute for consultation, evaluation or treatment by qualified healthcare professionals, and the information made available on or through the Service should not be relied upon when making medical decisions or to diagnose or treat a medical or health condition. You represent to us (which representation shall be deemed to be made each time you use the Service) that you are not using the Service for the purpose of seeking medical attention. You should consult your medical, health or other competent professional before reserving Product on the Service for medical use. We specifically disclaim all responsibility for any liability, loss or risk, personal or otherwise, that is incurred as a consequence, directly or indirectly, of the use or contents of the Service.

THE SERVICE IS NOT DESIGNED TO PROVIDE MEDICAL ADVICE OR FACILITATE MEDICAL EMERGENCIES. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING YOUR HEALTH. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY IN SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ ON THIS SITE OR THROUGH THE SERVICE. IF YOU THINK YOU HAVE A MEDICAL EMERGENCY, CALL YOUR DOCTOR OR 911 IMMEDIATELY. DO NOT RELY ON ELECTRONIC COMMUNICATIONS OR COMMUNICATION THROUGH THE SERVICE FOR IMMEDIATE, URGENT MEDICAL NEEDS.

We are not responsible if information made available on this Site is not accurate, complete or current. The material on this Site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this Site is at your own risk.

You may use the Service only by agreeing to all applicable Terms, including our Privacy Policy and only in compliance with this agreement and all applicable Tribal, federal, state, or local law, regulation, rule or ordinance that could give rise to any civil or criminal liability.

Use of Information

We reserve the right, and you authorize us, to use and assign all information regarding use of the Service by you and all information provided by you in any manner consistent with our Privacy Policy

Products

We do not sell Products through the Site or the Service. We allow users to reserve Products which users must pick up and purchase at the Wild Glow dispensary. You are responsible for ensuring that someone picks up and pays for your reserved Products at the scheduled time. We do not guarantee that all varieties of Products described on our Site, in our e-mails or in other communications to you will be available at the dispensary. Certain Products may have limited quantities. Products may not be returned or exchanged once purchased from the dispensary.

We limit the sales of our Products to individuals twenty-one (21) years of age or older. We reserve the right to limit the quantities of any Products that we offer. All descriptions of Products and Product pricing are subject to change at any time without notice, at our sole discretion; provided, we will not change Product pricing for any Product after you have reserved that Product through the Site. We reserve the right to discontinue any Product at any time. Any offer for any Product made on this Site is void where prohibited.

We do not warrant that the quality of any Products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

WE ATTEMPT TO INCLUDE ACCURATE DEPICTIONS OF OUR PRODUCTS ON THE SITE AND ON LABELING, BUT DO NOT GUARANTEE ACCURACY AND DISCLAIM ALL LIABILITY FROM YOUR RELIANCE ON SUCH INFORMATION.

Account Information

We reserve the right to refuse any Product reservation you place with us. We may, in our sole discretion, limit or cancel quantities of Product purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account. In the event that we make a change to or cancel a Product reservation, we may attempt to notify you by contacting the e-mail and/or phone number provided at the time the Product was reserved. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by resellers or distributors.

In order to reserve Products from our Site, you will be required to provide certain information including, but not limited to, your first name, last name, email address, physical address and telephone number, and to create a password and register with us. You are responsible for your registration, and for all use of the Service using any credentials or passwords issued to you or chosen by you. You will keep all such credentials and passwords confidential. You agree to provide current, complete and accurate account information for all reservations of Products made through our Site. You agree to promptly update your account and other information, including your email address, so that we can complete your reservations and contact you as needed.

All Product pricing shall be listed in U.S. dollars. When you purchase Products reserved through the Site, you are responsible for any applicable tax, duty, custom or other fee of any nature, other than taxes on Wild Glow’s income, imposed on the Products by any applicable government authority.

We will notify you if the Products you have reserved become unavailable prior to when you pick up and purchase them. You may contact us at [email protected] if you are not satisfied with your Products for any reason.

User Comments, Feedback and Other Submissions

If, at our request, you send certain specific submissions or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, publicity or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Personal Information

Your submission of personal information through the Service is governed by our Privacy Policy, which is incorporated herein by reference.

You understand that your content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

Limited License

Subject to the Terms and conditions of this Agreement, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the Service in accordance with the Terms of this Agreement. We reserve all rights not expressly granted herein in the Service and associated content. We may terminate this license at any time for any reason or no reason.

All rights, title, and interest in and to the Service not expressly granted in this Agreement are reserved by the company. Creative content, the Service, and our software, title, trade name, trademark, service mark, logo, domain name and/or any other identification with notable brand features are protected under applicable copyrights, trademarks, and other proprietary rights of the company. Except as expressly and unambiguously provided herein, we do not grant you any express or implied rights, and all rights in and to the Service and associated content are retained by us.

Minors

The Service is not offered to individuals under the age of 21. The Service does not knowingly collect personal information from children under the age of 13. If you are under 21, you are not permitted to use the Service or to send personal information to Wild Glow.

Disclaimers of Warranties

THE SERVICE IS PROVIDED "AS IS" AND WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ACCURACY. ADDITIONALLY, WE DO NOT WARRANT THAT THE SITE IS FREE FROM HARMFUL VIRUSES.

WE MAY AMEND OR MODIFY THE SERVICE AND ASSOCIATED CONTENT WITHOUT NOTICE TO YOU OR ANY LIABILITY TO YOU. YOU USE THE SERVICE AT YOUR OWN RISK AND YOU ASSUME TOTAL RESPONSIBILITY FOR YOUR USE OF THE SERVICE AND ANY LINKED SITES.

Limitations of Liabilities

UNDER NO CIRCUMSTANCES WILL THE COMPANY, ITS MEMBERS, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SUCCESSORS OR ASSIGNS BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, COST OF PROCURING SUBSTITUTE SERVICE OR LOST OPPORTUNITY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER IN AN ACTION IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, ANY LINKED SITE, OR RESULTING FROM A DELAY OR INABILITY TO USE THE SERVICE OR A LINKED SITE. UNLESS OTHERWISE EXPRESSLY SET FORTH IN A SEPARATE WRITTEN AGREEMENT WITH YOU, THE COMPANY SHALL NOT BE LIABLE FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE.

Indemnity

By using the Service, you agree to defend, indemnify, and hold harmless Wild Glow, its members, affiliates, officers, employees, agents, contractors, successors and assigns (“Indemnified Parties”) from and against any and all losses, claims, damages, costs and expenses (including but not limited to reasonable legal and accounting fees) that Indemnified Parties may incur arising or resulting from your use of the Service, the content of the Service, or your breach of this Agreement. Indemnified Parties reserve the right to assume or participate, at your expense, in the investigation, settlement and defense of any such action or claim.

Sovereign Entity

This Service is made available to you by Lac Vieux Desert Cannabis, LLC, d/b/a, Wild Glow Cannabis Company, a wholly owned and operated economic arm and instrumentality of the Lac Vieux Desert Band of Lake Superior Chippewa Indians (“Tribe”), a federally recognized Indian tribe, created for the benefit of the Tribe and operating pursuant to Tribal law.

Preservation of Sovereign Immunity

It is the express intention of the Tribe and Wild Glow, operating as an economic arm-of-the-tribe, to fully preserve, and not waive either in whole or in part, exclusive jurisdiction, sovereign immunity, and any other rights, titles, privileges, and immunities, to which they are entitled. To protect and preserve the rights of the parties, no person may assume a waiver of immunity exists except by express written resolution of the Tribe's Tribal Council specifically authorizing such a waiver as required by Article XIII of the Tribe’s Constitution specifically for the matter in question.

Termination

We may terminate this Agreement at any time, with or without notice, for any reason.
